Aircon maintenance contract in South Africa: what to put in it

A practical guide to the aircon maintenance contract in South Africa: unit schedule, CoC paperwork, sample clauses, how to win agreements and how to renew them.

Written for Owners and managers of aircon and HVAC companies in Gauteng, the Western Cape and KwaZulu-Natal serving office parks, retail centres, clinics and bodies corporate.

Key takeaways
  • Write who issues Certificates of Conformity and when, and keep every CoC with the unit it belongs to.
  • Quote in rand and state whether the price includes 15% VAT; managing agents compare quotes line by line.
  • Agree what happens over the December shutdown before it arrives, not on 23 December.
  • Ask in July which agreements end before October, so renewals are signed before summer.

A good aircon maintenance contract in South Africa is a service agreement that schedules every unit on site, sets the number of services a year, defines callout response times in and after hours, says how parts and gas are charged, gives the price in rand with VAT stated, explains renewal and exclusions, and makes clear who issues the paperwork. Done well, a managing agent can compare your quote line by line and, a year later, see what they paid for.

Compliance paperwork is part of the agreement

Refrigeration and air-conditioning practitioners must be registered with SAQCC Gas as "authorised persons", and a Certificate of Conformity (CoC) is issued through the SAQCC Gas app (SARACCA on registration, SARACCA on CoCs via the app; these are archived pages, so check current SAQCC Gas requirements for which work needs a CoC and which registration category may sign it).

For the contract, this means three practical lines:

  • the registered practitioner responsible for the site;
  • when a CoC is issued (for example after an installation, a modification or a repair that requires one) and how the client receives it;
  • that copies are kept with the unit's service history, so they can be produced if the client, the landlord or an insurer asks.

What an aircon maintenance contract must contain

Unit scheduleBuilding, floor or shop, unit type (split, cassette, ducted, packaged rooftop, VRF), capacity, make, serial number"All aircons on the premises"
Service frequencyServices per year and the checklist: filters, coils, drains, electrical connections, gas pressures"Quarterly service" with nothing about what is checked

Parts and gasIncluded consumables; how parts and gas are quoted and approvedRegassing disputed after the first leak
Price and paymentMonthly or annual price in rand, whether it includes 15% VAT, invoice and payment terms, PO numberQuote compared against one that excluded VAT
ComplianceRegistered practitioner, when CoCs are issued, where copies are keptCertificate cannot be found when the insurer asks
Term and renewalStart and end dates, notice period, annual escalationAgreement lapses quietly before summer
ExclusionsDucting and ceiling work, units beyond economical repair, damage from power surges, water or tenant installationsEvery major repair becomes an argument
Record after each visitSigned job card or service report with readings, findings, photos and recommendationsJob cards in a bakkie, photos on one phone

The December shutdown. Many clients and suppliers close over the festive season, in the hottest weeks. Write down who is on standby, how a callout is logged and whether after-hours rates apply.

Sample clauses to adapt

These short clauses are examples of the level of detail that prevents disputes. They are not a complete agreement; adapt them and have the final version reviewed by an attorney.

  1. Units covered. "This agreement covers the units in Annexure A. Units added later are covered after inspection and written addition to Annexure A."
  2. Services. "We will carry out [four] services per year per site following the checklist in Annexure B, on dates agreed with the centre or building manager."
  3. Callouts. "During business hours we will respond to a callout within [X] hours. After hours, weekends and public holidays, within [Y] hours, at the after-hours rate in Annexure C."
  4. Parts and gas. "Filters and cleaning materials are included. Parts and refrigerant are quoted in writing and supplied after approval."
  5. Compliance. "Work requiring a Certificate of Conformity will be carried out or supervised by a practitioner registered with SAQCC Gas, and a copy of the certificate will be provided to you."
  6. Escalation. "The agreement price escalates on each anniversary by [the agreed percentage or method]."
  7. Reporting and renewal. "After each service we will send a report with photos. We will send renewal terms at least 60 days before the end date."

How to get aircon maintenance contracts

At installation. A retail centre replacing rooftop units or a practice fitting out consulting rooms wants the warranty respected. Include the agreement with the installation quote and the CoC.

After a breakdown. The client just had a hot shop floor on a Saturday. Send a proposal that week.

In winter. From about June to August, managing agents and centre managers have time to review suppliers before the summer. Many bodies corporate also approve budgets at their annual meeting, so ask when it is and get your proposal in before.

Managing agents want one contractor for many buildings and reports for the owner; retail centres want cool trading hours and no tenant complaints; clinics want consulting rooms and medicine storage within temperature; bodies corporate want an annual cost the trustees can approve.

A sample email, to adapt:

Subject: Aircon maintenance agreement for Riverside Office Park Good morning Ms Naidoo, Block C's unit is running again and the CoC for the repair is attached. Before summer, we propose a maintenance agreement for all three blocks: four services a year, a set callout response in and after hours, CoCs kept with each unit, and a report with photos after every visit. The quote is in rand, VAT shown separately. Could we meet before your budget meeting? Regards, Sipho, Cape Breeze Aircon

The names are examples. Mention the site, attach what proves your work, and ask for one next step.

Keep the record so renewal is easy

At renewal, the managing agent has to show the owner or the trustees what they got. Prepare one page:

  • services completed, with dates and technician names;
  • callouts and response times;
  • findings per unit, parts replaced and CoCs issued;
  • recommendations still open and the quotes sent.

Start renewal 60 to 90 days before the end date. Questions worth asking every month:

  • "Whose agreement ends before October?" Ask it in July, so renewals are signed before the summer heat.
  • "Which units have open recommendations from the last service?"
  • "Which sites had the most after-hours callouts this year?" That is a higher tier or an escalation conversation.

Frequently asked questions

What is an aircon servicing contract?

An agreement in which you service a client's aircon units on a fixed schedule, for a fixed fee, with set callout response times. Parts and gas are usually quoted separately, and every service is recorded in a report.

What is a good format for an AC maintenance agreement?

A short main agreement with annexures: the unit schedule, the service checklist, callout rates and response times, and the compliance terms. The sample clauses above show the level of detail; have the final version reviewed by an attorney.

Is there an air conditioning maintenance agreement PDF I can use?

Build your own from the table and clauses above, then save it as a PDF. A generic template rarely covers CoCs, after-hours callouts or the December shutdown.

How do you get HVAC maintenance contracts?

Offer an agreement with every installation, follow up every breakdown with a proposal, and approach managing agents and bodies corporate in winter, before their budgets are approved. A record of past work and certificates is your best argument.
